Arkcess Terms of Service

1. Introduction

Welcome to Arkcess, Nigeria’s trusted platform for digital estate access, visitor management, and online estate levy payment. These Terms of Service (“Terms”) govern your use of the Arkcess Smart Access Platform, including our mobile and web applications, visitor pass code system, gated community security tools, and estate levy payment automation. By creating an account or using Arkcess, you agree to these Terms and our Privacy Policy, which complies with the Nigeria Data Protection Regulation (NDPR) 2019 and other applicable Nigerian laws. If you do not agree, please opt out of our services.

2. Key Definitions

  • “Arkcess” means Arkcess Technologies Limited, registered in Nigeria (RC number 1980393).
  • “Platform” means our mobile app, web portal, and other tools provided by Arkcess.
  • “Visitor Pass Code” means the temporary digital code generated to authorize visitor entry.
  • “Estate Levy Payment” means community fees, dues, or levies paid through the Arkcess system.
  • “User/Resident” means an individual, estate administrator, or organization that uses Arkcess.

    • 3. Eligibility

  • You must be 18 years or older to use Arkcess, or have verifiable guardian consent.
  • YUsers must provide accurate and up-to-date information when registering.
  • Only authorized residents, estate managers, or security administrators or staff may access the Smart Gate Pass system.

    • 4. Your Responsibilities

    When using Arkcess, you agree to:
  • Keep your account secure and confidential.
  • Use visitor pass codes responsibly and never share with unauthorized persons.
  • Pay all applicable estate levies and dues using the secure Arkcess platform.
  • Follow your estate’s internal visitor and levy rules, as communicated by management.
  • Promptly update your details if they change.
  • Comply with any updates or requirements made on the Platform.

    • 5. Visitor Pass Code Rules

  • Each Visitor Pass Code is unique, time-bound, and expires after first use or the set time limit.
  • Codes cannot be sold, transferred, duplicated, or misused.
  • Misuse of codes may result in suspension or termination of your account.
  • Arkcess and estate management reserve the right to block suspicious or fraudulent codes.

    • 6. Estate Levy Payment Terms

  • All payments made through Arkcess are processed via secure, encrypted payment channels in compliance with Central Bank of Nigeria (CBN) regulations.
  • Unless otherwise stated in your estate’s refund policy, all payments are final and non-refundable.
  • Users can view payment history, receipts, and levy status through their dashboard.
  • Arkcess is an intermediary platform and does not set levy amounts – these are determined by your estate management.

    • 7. Prohibited Activities

    You agree not to:
  • Attempt to hack, bypass, or disable Arkcess security systems.
  • Use Arkcess for unlawful estate entry or fraudulent activity.
  • Interfere with code generation, levy payments, or platform operations.
  • Upload or transmit harmful software, viruses, or malicious scripts.

    • 8. Data Protection & Privacy

  • Arkcess processes personal data in line with the Nigeria Data Protection Regulation (NDPR) and other applicable laws.
  • Your data (including visitor logs and payment records) will only be used for access control, levy collection, and estate management purposes.
  • We may share data with your estate management or authorized law enforcement agencies when legally required.

    • 9. Intellectual Property

    All content on Arkcess, including software, designs, trademarks, and logos, is owned by or licensed to Arkcess Technologies. You may not copy, reproduce, distribute, or modify any part of the platform without written permission.

    10. Limitation of Liability

    To the fullest extent permitted by Nigerian law, Arkcess is not responsible for:
  • Unauthorized use of visitor codes.
  • Delays, interruptions, or failures caused by internet providers, mobile networks, or third-party payment processors.
  • Actions, decisions, or levy policies determined by estate management.
  • All other related contingencies
    • Our liability is limited to the maximum extent allowed by the Laws of the Federal Republic of Nigeria.

    11. Suspension & Termination

    Arkcess may suspend or permanently terminate your account if you:
  • Breach these Terms,
  • Engage in fraud, misuse, or illegal activities, or
  • Violate estate or security policies.
    • You may also close your account at any time by contacting support to make a request.

    12. Updates to Terms

    We may update these Terms from time to time to reflect changes in technology, law, or business practices. Updates will be published on this page with a revised “Last Updated” date. Continued use of Arkcess after updates means you accept the revised Terms.
